ORDINANCE NO. 949 AN ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY IDAHO, AMENDING TITLE 10 "FLOOD CONTROL", CHAPTER 1 "FLOOD CONTROL REGULATIONS", SECTION 8-6 "SPECIFIC STANDARDS"; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Eagle, Idaho is a municipal corporation organized and operating under the laws of the State of Idaho; and WHEREAS, pursuant to Chapter 65, Title 67, Idaho Code, the City of Eagle has the authority to adopt, establish and amend a Zoning Ordinance; and WHEREAS, the Mayor and Council have determined that amending the Eagle City Flood Control Code is necessary to protect public health and safety of the City and to ensure continued compliance with the City's Community Rating System (CRS) program; and WHEREAS, the proposed changes to the Eagle Flood Control Code is in accordance with the City of Eagle Comprehensive Plan; NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF EAGLE, Ada County, Idaho; Section 1: That Title 10, Chapter 1, Section 8, be and is hereby amended, to read as follows with underline text to be added and strike-through text to be deleted: 10-1-8-6: SPECIFIC STANDARDS: In all cases of special flood hazards where base flood elevation (BFE) data has been provided as set forth in section 10-1-6 of this chapter, the provisions of this section shall be required: A. Residential Construction: 1. New construction and substantial improvement of any residential structure (including manufactured homes) shall have a the lowest finished floor elevated no lower than the flood protection elevation, as defined in section 10-1-5, and the lowest floor, including basement and crawl space, shall be elevated to a minimum of one foot (1') above the base flood elevation. 5. Mechanical and Other Service Equipment: a. All mechanical, electrical, plumbing, and other service equipment servicing residential structures, including manufactured homes, shall be elevated to a minimum of one foot (1') above the base flood elevation (BFE). This includes, but is not limited to, HVAC systems, furnaces, hot water heaters, and electrical panels. C. Manufactured Homes: a. New, substantially damaged, substantially improved, and replacement manufactured homes shall be elevated so that the lowest floor of the manufactured home, including the basement, and all mechanical, electrical, plumbing, and other service equipment, are is no lower than the flood protection elevation, as defined in section 10-1-5.
