Naert a/k/a Zachary Naert Under and by virtue of Execution Against Property issued to me by the Clerk of Court for Beaufort County on the 7th day of February 2025 against Zachary S. Naert a/k/a Zachary Naert in the amount of $113,116.47, I will sell to the highest bidder at Public Auction, at Beaufort County Courthouse, Ribaut Road, Beaufort, South Carolina, at 11:00 a.m. on the 2nd day of September 2025, the following parcel described to-wit: ALL that certain Condominium Apartment lying and being on Hilton Head Island, Beaufort County, South Carolina, and being known as Apartment Number 43 Ocean Breeze, Treetops Horizontal Property Regime, Phase IV, and being more particularly shown and described by reference to the Master Deed of Treetops Horizontal Property Regime, recorded on December 19,1983, in Deed Book 384 at Page 259, re-recorded on December 30 1983, in Deed Book 385 at Page 103 and re-recorded on February 3, 1984, in Deed Book 387 at Page 1110, and as amended thereafter from time to time by formal Amendments to Master Deed recorded in the Office of the Register of Deeds for Beaufort County, South Carolina, and all other amendments thereto. ALSO, all the rights privileges and common elements appertaining to the above described Apartment as set forth in the Master Deed and By-Laws of Treetops Horizontal Property Regime as amended, referred to hereinabove. Subject to those certain covenants, rights, restrictions, conditions, easements, option and assessments as created or reserved in, and shown by instruments recorded in Beaufort County, South Carolina records and contained in the above-described Master Deed and By-Laws and any amendments thereto, recorded in the Office of the Register of Deeds for Beaufort County, South Carolina in Deed Book 78 at Page 306, Deed Book 178 at Page 243, Deed Book 179 at Page 18, Deed Book 218 at Page 144, Deed Book 418 at Page 1361 and all other amendments and re-recordings thereto. Property Address: 19 Lemoyne Ave Apt 43 Tax Map Number: R553 018 000 0267 0043 Legal Description: APT 43 TREETOPS HPR PH IVG PB48 P45 A deposit of five percent (5%) of the bid price in certified funds must be posted at the end of the day at the Initial Sale by any bidder other than the Judgment Holder. The Sale will remain open for Thirty (30) days as to all third-party bidders ("Upset Bid"). The Sale shall re-open at the Beaufort County Courthouse, Beaufort, South Carolina at 11:00 am on 13th day of October 2025, the Thirtieth (30th) day after the Initial Sale. If there is a successful bid when the sale re-opens on the 30th day, the successful bidder at the Upset bid must post a Five Percent (5%) deposit in certified funds by close of business day. The successful bidder shall have Thirty (30) days to comply with the balance of the bid with certified funds. Until the date of compliance, interest will be charged at the Judgment interest rate of 11.5% pursuant to §34-31-20(B). The deposit will be applied towards the purchase price unless the bidder defaults, in which case the deposit will be forfeited and paid to the judgment holder, less the Sheriff's fees and costs.
