By virtue of a power of sale contained in a certain security deed from Otis Daniels Jr. and Otis Daniels to Mortgage Electronic Registration Systems, Inc., as grantee, as nominee for CMG Mortgage, Inc. dba CMG Financial, its successors and assigns and recorded in Deed Book 13641, Page 318, Muscogee County, Georgia records given to secure a note in the original amount of $146,900.00 with interest on the unpaid balance until paid, the following described property will be sold at public outcry to the highest bidder for cash at the courthouse door of MUSCOGEE COUNTY, Georgia, or at such place as has or may be lawfully designated as an alternative location within the legal hours of sale on the first Tuesday in September, 2025, to wit: September 02, 2025, the following described property:
All that lot, tract and parcel of land situate, lying and being in Columbus, Muscogee County, Georgia, being known and designated as part of Lot Numbered Eleven (11), Block Lettered "E", Revised Plat of Lakewood Subdivision, as said lot is shown upon a map or plat of said subdivision prepared by Moon, Meeks & Patrick, Inc., dated June 14, 1988 and recorded in Plat Book 106, Page 59 in the Office of the Clerk of the Superior Court of Muscogee County, Georgia, to which reference is made for a more specific location and dimensions of said lot Located thereon is house numbered 2122 40th Street, according to the present numbering of dwellings in Columbus, Georgia
The above-described property is conveyed together with and/or subject to all valid and enforceable restrictive covenants, zoning ordinances and easements of record.
This is the same property conveyed in that certain Chris B. Campbell and George A. Campbell to Jimmy Hicks, dated 11/04/2020, filed 11/08/2020, and recorded in Deed Book 13155, Page 132, in the Office of the Clerk of Superior Court of Muscogee County, Georgia
Being real property commonly known as 2122 40th St, Columbus, GA 31904.
The debt secured by the above-referenced security deed has been declared due because of the default in the payment of said debt per the terms of the note and other possible defaults by the borrower or the successor thereto. The debt remaining in default, this sale will be made for the purpose of paying the debt and all expenses of this sale including attorney's fees (notice of intent to collect attorney's fees having been given).
Said sale will be made subject to the following items which may affect the title to said property: All restrictive covenants, easements and rights-of-way appearing of record, if any; all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the property; all outstanding or unpaid bills and assessments for street improvements, curbing, garbage, water, sewage and public utilities which may be liens upon said property; and any outstanding taxes, assessments and other liens superior to the security deed being foreclosed hereby. To the best knowledge and belief of the undersigned, the above-described property is in the possession of the borrower and/or other persons with the consent and acquiescence of the borrower.
