PUBLISHED NOTICE NOTICE OF PUBLIC HEARING RELATING TO THE MAXIMUM STORMWATER UTILITY FEES IN THE VILLAGE OF KEY BISCAYNE Notice is hereby given that the Village Council of the Village of Key Biscayne (the “Village”) will hold a public hearing on August 19, 2025, at 6:30 p.m. or as soon as practicable thereafter, during the Village Council Meeting at the Council Chambers located at 560 Crandon Boulevard, Key Biscayne, FL 33149, for the purpose of considering an increase to the Maximum Stormwater Utility Fee that may be collected commencing October 1, 2026, and in subsequent fiscal years. All affected property owners have a right to appear at the hearing and to file written objections with the Village Council within 20 days of this notice. The purpose of the Stormwater Utility Fee is to fund the planning, construction, operation, and maintenance of the Village Stormwater Management System, which stormwater management system is re- quired pursuant to Section 403.0891, Florida Statutes. The Stormwater Utility Fee is comprised of two com- ponents: (A) a Base Fee attributable to the Stormwater Management System for roadways and sidewalks allocated upon a Rate Per Trip basis, and (B) a Parcel Fee based upon the impervious area relating to each developed property. For Fiscal Year 2025-26, the estimated revenue to be collected within the Village from the Storm- water Utility Fee, is estimated to be $2,435,200.16, of which $348,574.00 is associated with the 15.5% Base Fee and the remaining $2,086,626.16 is associated with the Parcel Fee, including the cost of collection. For future fiscal years, the maximum revenue that may be collected from the proposed Maximum Stormwater Utility Fee is $7,436,720.85 (including cost of collection), of which $1,064,725.15 is associated with the 15.5% Base Fee and the remaining $6,371,995.70 is associated with the Parcel Fee, including the cost of collection. With respect to the calculation of the FY 2025-26 Base Fee, a Per Trip Rate of $5.5042 shall be imposed. The annual Base Fee is calculated by dividing each property’s average daily trip generation. In order to provide for any escalation in Annual Stormwater Management System Costs for any future Fiscal Years, a Base Fee Maximum Rate is proposed in an amount not to exceed a Per Trip Rate of $16.8126. With respect to the calculation of the FY 2025-26 Parcel Fee, a Rate Per Impervious Area of $0.1340, which includes the cost of collection, shall be imposed. The Parcel Fee to be collected is based upon the impervious area for each developed property. In order to provide for any escalation in Annual Stormwater Management System Costs for any future Fiscal Years, a Parcel Fee Maximum Rate, which includes the cost of collection, is proposed in an amount not to exceed a Rate Per Impervious Area of $0.4092. Annual Stormwater Utility Fees are collected by the Miami-Dade County Tax Collector through the tax bill to be mailed in November 2025 and subsequent years pursuant to Section 197.3632, Florida Statutes and Section 29-5 of the Village Code of Ordinance. Failure to pay the fee will cause a tax certificate to be issued against the property which may result in a loss of title. Pursuant to Section 286.0105, Florida Statutes, if you decide to appeal any decision made by the Village Council with respect to any matter considered at the hearing or at any subsequent meeting to which the Village Council has continued its deliberations, you will need a record of the proceedings and may need to ensure that a verbatim record is made, including the testimony and evidence upon which the appeal is to be made. In accordance with the Americans with Disabilities Act, persons needing a special accommodation or an interpreter to participate in this proceeding should contact the Village Clerk, at (305)365-5506 at least seven days prior to the hearing. Unless proper steps are initiated in a court of competent jurisdiction to secure relief within 20 days from the date of Village Council action at the above hearing, such action shall be the final adjudication of the issues presented.
