Each and every Owner listed in this Notice of Sale is in default of their obligation to pay common expenses (maintenance fees, assessments) to the Island Club Horizontal Property Regime III as provided for by the Master Deed of Andrick Development Corp., establishing said Horizontal Property Regime, said Deed being dated the 2nd day of September, 1977, and recorded in the Office of the Register of Mesne Conveyances for Beaufort County, South Carolina, in Deed Book 254 at Page 1094 on October 4, 1977, as amended.
EACH TIMESHARE INTERVAL WILL BE AUCTIONED SEPARATELY.
Each Sale shall require the highest bidder, other than Island Club Horizontal Property Regime III Council of Co-Owners, to pay in cash or certified funds. If Island Club Horizontal Property Regime III Council of Co-Owners is the successful bidder at the Sale, it shall receive as a credit against the bid price of a sum equal to the amount of assessments, costs and fees set forth in this Notice of Sale. The sale of each timeshare property sold hereunder shall be conveyed to the Purchaser subject to taxes and assessments, existing easements and restrictions of record, and any senior mortgage lien. Each Purchaser shall pay for the preparation of the deed, documentary stamps on the deed, Hilton Head Island Transfer Tax, and the costs of recording the deed to the timeshare property purchased. Sale of any property is in full satisfaction of the above-recited debt.
