NOTICE OF PUBLIC HEARING The Durham City Council will hold a public hearing on Monday, August 4, 2025, at the meeting that begins at 7:00 PM, to consider an Ordinance to Revise Durham City Code Article X -Stormwater Performance Standards for Development and Article XI – Stormwater Facility Replacement Fund. The proposed Ordinance can be viewed at the following link: https://www.durhamnc.gov/DocumentCenter/View/60979 This meeting will be held in person in Council Chambers at 101 City Hall Plaza, Durham, NC and remote participation is also available online using the Zoom virtual meeting platform. You may register to speak virtually at the hearing at: https://us06web.zoom.us/webinar/register/WN_r5vp0nnKSJmMFJxkyiEIyA (Webinar ID: 819 7670 3441). Your registration must be submitted by 2 PM on the day of the City Council meeting. After registering, you will receive a confirmation email containing information about joining the meeting. Instructions to participate in the meeting are available at: https://durhamnc.gov/3012/Public-Hearings-and-Notices If you wish to submit written comments, you may send them via email to StormwaterBMPs@durhamnc.gov, via USPS to Stormwater Services, 101 City Hall Plaza, 3rd Floor, Durham, NC 27701, or via hand delivery to the City Hall Lobby, 101 City Hall Plaza, Durham, NC 27701, attention "City of Durham Stormwater Performance Standards for Development." The Durham City Code Article X - Stormwater Performance Standards for Development and Article XI - Stormwater Facility Replacement Fund found in City Code Sections 70-742 through 70-752 are proposed to be revised as follows: Eliminate the requirement for Stormwater Control Measure (SCM) owners to make payments into the Stormwater Facility Replacement Fund (SFRF) and make participation in the SFRF optional Eliminate the alternative perpetual surety options Create a new section (70-753) establishing procedures for owners to request refunds from the SFRF Require SCM owners to retain their own maintenance funds in accordance with NCGS 160D-925(d1) If approved by City Council, the Ordinance will be effective on August 4, 2025.
