NOTICE OF SERVICE OF PROCESS BY PUBLICATION STATE OF NORTH CAROLINA, COUNTY OF ROWAN IN THE GENERAL COURT OF JUSTICE, SUPERIOR COURT DIVISION 25 CVS 454 FOUNDERS FEDERAL CREDIT UNION, Plaintiff, vs. FRANCISCO ESPINOZA HERNANDEZ, Defendant. TO: FRANCISCO ESPINOZA HERNANDEZ TAKE NOTICE that a pleading seeking relief against you has been filed in the above-entitled action. The nature of the relief being sought is as follows: On or about November 26, 2019, Francisco Espinoza Hernandez ("Defendant") executed a Consumer Lending Plan (the "Consumer Lending Plan") with Founders Federal Credit Union ("Plaintiff"). Thereafter, on or about April 23, 2021, Plaintiff extended a line of credit to Defendant ("the LOC") subject to a Truth-in-Lending Disclosure Statement – Account Opening Disclosures and the Consumer Lending Plan. On or about May 20, 2022, Plaintiff converted the credit card associated with the LOC to a MasterCard with terms and conditions as set forth and provided to Defendant (the "LOC Note"). Defendant failed to make payments when due on the Consumer Lending Plan, the LOC, and the LOC Note. After providing all credits due to Defendant on the Consumer Lending Plan, the LOC, and the LOC Note, Defendant owes Plaintiff the sum of no less than $1,677.14 plus interest accruing thereon from and after the date of judgment at the lower of the maximum legal rate or the rate of the LOC Note until paid and attorney's fees, pursuant to the Consumer Lending Plan, the LOC, the LOC Note, and N.C. Gen. Stat. § 6-21.2 in the amount of $251.57, which is 15% of the amount due under the Consumer Lending Plan, the LOC, and the LOC Note. Thereafter, on or about July 22, 2022, Plaintiff advanced funds to Defendant subject to the Consumer Lending Plan and a Consumer Lending Plan Advance Receipt and Truth-in-Lending Statement (the "Note"). Defendant failed to make payments when due on the Consumer Lending Plan and the Note. After providing all credits due to Defendant on the Consumer Lending Plan and the Note, Defendant owes Plaintiff the sum of no less than $5,067.35 plus interest accruing thereon at the rate of $2.15 per day from and after November 1, 2024 until the date of judgment, and thereafter at the lower of the maximum legal rate or the rate of the Note until paid and attorney's fees, pursuant to the Consumer Lending Plan, the Note, and N.C. Gen. Stat. § 6-21.2 in the amount of $760.10, which is 15% of the amount due under the Consumer Lending Plan, and the Note. You are required to make defense to such pleading no later than August 25, 2025, said date being 40 days from the date of first publication of this notice, and upon your failure to do so the party seeking service against you will apply to the court for the relief sought.
