Notice of Sale C/A No: 2024-CP-46-00090 BY VIRTUE OF A DECREE of the Court of Common Pleas for York County, South Carolina, heretofore issued in the case of Bank of America, N.A. vs. Devin A Patton; Trice Stewart; Neighborhood Assistance Corporation of America; Founders Federal Credit Union; Amber Ridge Home Owners Association I the undersigned as Master-in-Equity for York County, will sell on August 4, 2025 at 11:00 am at Moss Justice Center, 1675 York Hwy York, SC 29745 Legal Description and Property Address: ALL THAT certain piece, parcel or lot of land, with any improvements thereon, situate, lying and being in the City of Rock Hill, County of York, State of South Carolina, and being known and designated as Lot 146, AMBER RIDGE, Map 2, as shown on a plat thereof recorded in the Office of the Clerk of Court for York County in Plat Book C-226, Page 5. Reference is hereby made to said plat for true metes and bounds and a more complete and accurate description. THIS BEING the same property conveyed unto Devin Patton by virtue of a Special Warranty Deed from The Secretary of Housing and Urban Development dated August 8, 2016, and recorded August 10, 2016, in Book Volume15850 at Page 328 in the Office for the Register of Deeds for York County, South Carolina. THEREAFTER, being the same property Devin Patton conveyed fifty percent interest unto Trice Stewart by virtue of a Quit Claim Deed dated April 14, 2021, and recorded April 14, 2021, in Book RB 19176 at Page 275 in the Office of Clerk of Court for York County, South Carolina. 1501 Andora Drive Rock Hill, SC 29732 TMS# 634-08-01-200 TERMS OF SALE: For cash. Interest at the current rate of 2.375% to be paid on balance of bid from date of sale to date of compliance. The purchaser to pay for papers and stamps, and that the successful bidder or bidders, other than the Plaintiff therein, will, upon the acceptance of his or her bid, deposit with the Master-in-Equity for York County a certified check or cash in the amount equal to five percent (5%) of the amount of bid on said premises at the sale as evidence of good faith in bidding, and subject to any resale of said premises under Order of this Court; and in the event the said purchaser or purchasers fail to comply with the terms of sale within Twenty (20) days, the Master-in-Equity for York County shall forthwith resell the said property, after the due notice and advertisement, and shall continue to sell the same each subsequent sales day until a purchaser, who shall comply with the terms of sale, shall be obtained, such sales to be made at the risk of the former purchaser. As a personal or deficiency judgment is demanded, the bidding will remain open for a period of thirty (30) days pursuant to the S.C. Code Ann. Section 15-39-720 (1976). If the Plaintiff or the Plaintiff's representative does not appear at the above-described sale, then the sale of the property will be null, void, and of no force and effect. In such event, the sale will be rescheduled for the next available sales day. Plaintiff may waive any of its rights, including its right to a deficiency judgment, prior to sale. Sold subject to taxes and assessments, existing easements and restrictions of record. Neither the Court, nor Plaintiff, nor Plaintiff's counsel makes any warranty of title or representations with regard to the condition or existence of any improvements on the subject property.
