NOTICE OF APPLICATION Notice is hereby given that Bryan A. Phillips, Ytterberg Deery Knull LLP, 3737 Buffalo Speedway, Suite 1500, Houston, Texas 77098-3738, acting as Organizer, filed a Trust Company Charter Application with the Texas Department of Banking on June 20, 2025, to establish Elm Creek Trust Company LTA (a Texas Limited Trust Association) as a Texas state trust company at 777 Main, Suite 3440, Fort Worth, TX 76012, pursuant to Section 182.003 of the Texas Finance Code (the "Code"), and an application for certain exemptions pursuant to 7 TAC 21.24 as a trust company administering family trusts pursuant to Section 182.011 of the Code. Any person wishing to comment on this application, either for or against, may file written comments with the Texas Department of Banking, 2601 North Lamar Boulevard, Austin, Texas 78705-4294 on or before the 14th day after the date of this publication. Such comments will be made a part of the record before and considered by the banking commissioner. Any person wishing to formally protest and oppose the Trust Company Charter Application and participate in the application process may do so by filing a written notice of protest with the Texas Department of Banking on or before the 14th calendar day after the date of this publication accompanied by a protest filing fee of $2,500.
