SUBSTITUTED TRUSTEE'S NOTICE OF SALE
WHEREAS, on June 16, 2009, Jeremy K. Ellzey and Christie L. Ellzey, husband and wife, executed a certain deed of trust to Lem Adams, III, Trustee for Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for Freedom Mortgage Corporation of New Jersey, its successors and assigns, which deed of trust is of record in the Office of the Chancery Clerk of Jackson County, State of Mississippi in Book 2824 at Page 511, Instrument # 200913437; and
WHEREAS, said deed of trust was subsequently transferred and assigned to Nationstar Mortgage LLC by instrument dated May 9, 2025, and recorded in Book 2210 at Page 42, Instrument # 202508446 of the aforesaid Chancery Clerk's office; and
WHEREAS, Nationstar Mortgage LLC, has heretofore substituted McPhail Sanchez, LLC as Trustee by instrument dated June 25, 2025, and recorded in the aforesaid Chancery Clerk's Office in Book 4162 at Page 84, Instrument # 202511844; and
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, Nationstar Mortgage LLC, the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust and for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expense of sale.
NOW, THEREFORE, McPhail Sanchez, LLC, Substituted Trustee in said deed of trust, will on August 20, 2025 offer for sale at public outcry through duly appointed auctioneer and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the West Front Door of the Jackson County Courthouse, located at 3104 Magnolia Street, Pascagoula, MS 39567 to the highest and best bidder for cash the following described property situated in Jackson County, Mississippi, to-wit:
The North 32 feet of Lot 37 and all of Lot 38 and the South 34 feet of Lot 39, Block 5, Virginia City Subdivision, Section 35, Township 6 South, Range 9 West, as per plat or map recorded in the Office of the Chancery Clerk of Jackson County, Mississippi.
Chain of Title: Bailey to Ellzey and Bailey via WD recorded 8-21-2003, 1314/24.
I WILL CONVEY only such title as vested in me as Substituted Trustee.
