MORALES, NASH, STEAD AND WILLITS.
AN ORDINANCE (CAR24-00012) FOR PROPERTY LOCATED AT 2272 S FIVE MILE ROAD AMENDING ZONING CLASSIFICATIONS OF THE CITY OF BOISE CITY TO CHANGE THE CLASSIFICATION OF REAL PROPERTY PARTICULARLY DESCRIBED IN SECTION 1 OF THIS ORDINANCE AND ADJACENT RIGHTS OF WAY FROM R-1B (RESIDENTIAL: SUBURBAN) TO R-1C (RESIDENTIAL: TRADITIONAL); SETTING FORTH A REASONED STATEMENT IN SUPPORT OF SUCH ZONE CHANGE; PROVIDING FOR A WAIVER OF THE READING RULES; AND PROVIDING AN EFFECTIVE DATE.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO:
Section 1. That the land use zoning classification of the following described lands within the City of Boise City, Idaho, as set forth in Exhibits A (Map) and B (Legal Description) are amended and reclassified from R-1B (Residential: Suburban) to R-1C (Residential: Traditional), pursuant to the procedures and requirements of Title 67, Chapter 65, Idaho Code, Title 11, Chapter 5, Boise City Code, and the Boise City Comprehensive Plan, as a result of changed circumstances and to promote the public health, safety, and welfare.
Section 2. The lands described in Section 1 hereof are subject to the AI-O (Airport Influence Overlay) Sensitive Lands Overlay District and the standards in Boise City Code Title 11, Chapter 2, Section 7 as modified from time to time by Boise City ordinance.
Section 3. The lands described in Exhibit B is subject to a Development Agreement, and any and all subsequent development must comply with the standards described in the Development Agreement.
Section 4. Pursuant to Idaho Code § 67-6535, the Boise City Council hereby adopts the following Reasoned Statement:

The proposed rezone from R-1B/AI-O (Residential: Suburban with an Airport Influence Overlay) to R-1C/AI-O/DA (Residential: Traditional with an Airport Influence Overlay and Development Agreement) is consistent with the approval criteria of Boise City Code (BCC) Section 11-05-05-4.I (Zoning Map Amendment). The subject property is designated as "Suburban", within which the R-1C zone is allowed. The proposal is compatible with the adjacent single-family residential, and provides additional housing within the Boise city limits, reducing vehicle miles traveled as supported the comprehensive plan (Policy CC1.1). The subject property is located along an arterial roadway, where increased density is supported. The subject property is located within the Airport Influence Area A (AIA A), where new residential uses are allowed with sound mitigation and an avigation easement. As proposed, the rezone would provide an additional mix of housing and would develop with pedestrian-oriented streetscapes, as encouraged by Blueprint Boise Principles GDP N.3 and GDP N.5. The development agreement will further ensure that the proposed development is compatible with the scale and character of the surrounding neighborhood by limiting the building height to match the adjacent R-1B zone's building height limit.
Section 5. The zoning maps of the City of Boise City, Idaho, are hereby changed, altered, and amended to include and insert the real property described in Exhibits A and B hereof in the land use classification herein described.
Section 6. That pursuant to the affirmative vote of one-half (1/2) plus one (1) of the members of the full Council, the rule requiring two (2) separate readings by title and one (1) reading in full be, and the same is hereby, dispensed with, and accordingly, this Ordinance shall be in full force and effect following its passage, approval, and publication of this Ordinance in the official newspaper of the City of Boise.
