Ordinance NO. ORD-20-25 BY THE COUNCIL CORLESS, HALLYBURTON, MORALES, NASH, STEAD AND WILLITS. AN ORDINANCE AMENDING BOISE CITY CODE TITLE 5, CHAPTER 2, GENERAL OFFENSES; CREATING THE OFFENSE OF "CONTROL OF SPEED" AND RENUMBERING THE SUBSEQUENT PROVISION ACCORDINGLY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the city of Boise City ("City"), through Idaho Code ("I.C.") §§ 50-302 and 50-314, as well as Article 12, Section 2 of the Idaho Constitution, can regulate, limit, and control traffic upon streets and public ways within the City, including along the Greenbelt; and WHEREAS, excessive and unreasonable speed along the Greenbelt harms the public's health, safety, and welfare; and WHEREAS, the City is authorized to enter into joint or cooperative action agreements and mutual assistance compacts with the other public agencies pursuant to I.C. §§ 67-2328 and 67-2337; and WHEREAS, the City, having entered into such an agreement with Ada County and the cities of Garden City, Eagle, and Star, wherein the Parties granted to each other the authority to enforce laws within the territorial limits of the Greenbelt, now desires to update Boise City Code Title 5, Chapter 2 to prohibit excessive and unreasonable speed along the Greenbelt. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO: Section 1. That existing Boise City Code Title 5, Chapter 2, Section 16, shall be, and hereby is, amended to read as follows: 5-2-16: CONTROL OF SPEED: No person shall travel upon the Greenbelt, as defined in section 11-06-03 of this Code, at a speed greater than, or in a manner that is not, reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing. A violation of this provision is an infraction, subject to penalty as provided in section 1-4-2 of this Code. However, if such travel also endangers or is likely to endanger any person or property, then the violation is a misdemeanor, subject to penalty as provided in section 1-4-1 of this Code. Section 2. That existing Boise City Code Title 5, Chapter 2, Section 16 shall be, and hereby is, renumbered accordingly. Section 3. That this Ordinance shall be in effect immediately upon its passage, approval, and publication. ADOPTED by the Council of Boise City, Idaho, on July 8, 2025.
