NOTICE OF PUBLIC HEARING ON INTENTION TO FORM CITY OF MODESTO COMMUNITY FACILITIES DISTRICT NO. 2025-2 (VILLAGE ONE TRIANGLE), LEVY SPECIAL TAXES THEREIN, AND DESIGNATE FUTURE ANNEXATION AREA NOTICE IS HEREBY GIVEN that on June 10, 2025 the City Council of City of Modesto (hereinafter referred to as the "City Council") adopted its Resolution No. 2025-196 (the "Resolution"), declaring its intention to establish the City of Modesto Community Facilities District No. 2025-2 (Village One Triangle) (the "Community Facilities District"), and authorize the levy of a special tax therein, a summary of such resolution is set forth below. PUBLIC HEARING NOTICE IS HEREBY GIVEN that a public hearing will be held on July 22, 2025, at the hour of 5:30 p.m., or as soon thereafter as such matter can be heard, in the Modesto City Council Chamber at 1010 Tenth Street, Modesto, California 95353, and via livestream through a link on modestogov.com, at which time the City Council will hear evidence and testimony by all interested persons, property owners, voters and taxpayers for or against (1) the establishment of the Community Facilities District, (2) the extent of the Community Facilities District and the designation of future annexation area for the Community Facilities District ("Future Annexation Area"), (3) the description of certain Facilities and Services described in the Resolution of Intention to Establish the Community Facilities District to be financed by the Community Facilities District, (4) the levy of special taxes within the Community Facilities District, and (5) any other matters as set forth in the Resolution. Oral comments will only be accepted from those in person. All persons interested, including property owners, taxpayers and registered voters, may appear at the hearing and present evidence and testimony for or against items (1) through (5) above. Any protest pertaining to the regularity or sufficiency of the proceedings relating to the proposed issues described in items (1) through (5) above must be in writing and shall clearly state the irregularities or defects to which objection is made, and shall be filed with the City Clerk on or before the time set for the hearing. If fifty percent (50%) or more of the registered voters, or six (6) registered voters, whichever is more, residing within the Community Facilities District, or the owners of more than one-half (1/2) of the area of land within the Community Facilities District, and not exempt from the special tax file written protests against any of items (1) through (5) above, and protests are not withdrawn so as to reduce the protests to less than a majority, the City Council shall abandon that portion of the proceedings pertaining to such item(s) and no further proceedings with respect to such item(s) shall be taken for a period of one year from the date of the determination by the City Council. The City Council may modify the proceedings if such majority protests are only against a specified issue. If the City Council determines to submit to an election the questions of levying special taxes within the Community Facilities District, an election will be held within the Community Facilities District for such purposes. At such an election, each landowner (as defined in Section 53317 of the California Government Code) within the Community Facilities District shall be entitled to cast one vote for each acre or portion thereof owned by such landowner within the Community Facilities District. For a proposition to be adopted, two-thirds of the votes cast at the election must favor passage. SUMMARY OF RESOLUTION OF INTENTION TO ESTABLISH THE COMMUNITY FACILITIES DISTRICT The following is a summary of the Resolution of Intention to Establish the Community Facilities District, adopted by the City Council on June 10, 2025. A copy of the Resolution and other resolutions relating to the Community Facilities District are available on request from the City Clerk at the address specified below. The Resolution recites that the owner of not less than ten percent (10%) of the area of land within the proposed Community Facilities District filed a written petition with the City to establish the Community Facilities District pursuant to the Mello-Roos Community Facilities Act of 1982, as amended, to finance as provided in the Resolution (i) the costs of acquisition, construction and improvement of authorized public facilities, including water, wastewater and storm drain system improvements, road improvements and canal crossing improvements; (ii) the costs of authorized services including, but not limited to, maintenance, repair and replacement of the neighborhood park(s), arterial road parkway, median and roundabout landscaping, tree pruning, connector street parkway, median landscaping, bike trails, masonry walls, central basin and storm drain facilities, including but not limited to, litter and debris removal, pruning, staking, fertilizing, plant replacement and restoration, fire and weed control, erosion control, trimming of vegetation, and storm drain system maintenance, including related reserves for the replacement of plants and materials, replacement of storm water treatment filters and other storm drainage facilities; (iii) the incidental expenses associated with (i) and (ii), (iv) the cost of related reserves and sinking funds, and (v) certain administrative expenses. The Resolution goes on to state that the boundaries of the Community Facilities District if it is formed (including the proposed Future Annexation Area), would be as shown on a map thereof on file in the office of the City Clerk. The Resolution declares the intention of the City Council to form the Community Facilities District and to levy special taxes on all non-exempt real property in the Community Facilities District sufficient to pay for some or all of the Facilities and Services and incidental expenses referred to above. The rate, method of apportionment and manner of collection of each special tax is described in detail in Appendix B attached to the Resolution (the "Rate and Method"). The City Council determined the Rate and Method to be reasonable. The Resolution then goes on to provide for the public hearing of which this document gives notice and states that, if the City Council determines to form the Community Facilities District, a special election will be held to authorize the levy of the special taxes in accordance with the procedures contained in California Government Code Section 53326. The Resolution provides that, if such a special election is held, the voting procedure will be a landowner vote, with each landowner of record having one vote for each acre of land or portion thereof within the Community Facilities District.
