SUBSTITUTE TRUSTEE'S NOTICE OF SALE STATE OF MISSISSIPPI COUNTY OF HARRISON SECOND JUDICIAL DISTRICT WHEREAS, on the 17th day of November, 2022, Rene Edward Rivas and Jackelina Del Socorro Rivas executed a Deed of Trust to Nicole T. Lewellyn, Trustee for the benefit of PriorityOne Bank, said Deed of Trust is recorded as Instrument No. 2022-0008973-T-J2 in the Office of the Chancery Clerk of Second Judicial District, Harrison County, Mississippi; WHEREAS, the aforesaid PriorityOne Bank, the holder of said Deed of Trust and the promissory note secured thereby, substituted Derek A. Henderson as Trustee therein as authorized by the terms thereof, by instrument dated June 12, 2025 and recorded June 27, 2025, in the Office of the Chancery Clerk of the Second Judicial District, Harrison County, Mississippi, as Instrument No. 2025-0004075-T-J2; WHEREAS, default having been made in the terms and conditions of said Deed of Trust and the entire debt secured thereby, having been declared to be due and payable in accordance with the terms of said Deed of Trust, and the legal holder of said indebtedness, PriorityOne Bank, having requested the undersigned Trustee to execute the trust and said Deed of Trust for the purpose of raising the sums due thereunder together with attorney's fees, Trustee's fees and expenses of sale; NOW, THEREFORE, I, DEREK A. HENDERSON, TRUSTEE, in said Deed of Trust, will on the 12th day of August, 2025, offer for sale and will sell at public outcry, to the highest bidder for cash, within the legal hours (being the hours of 11:00 a.m. and 4:00 p.m.) at the South Front Door of the Harrison County Second Judicial District Courthouse, at Biloxi, Mississippi, the following described property situated and lying in Harrison County, Mississippi, to-wit: Lot 10, Block 5, Edgewater Estates, Subdivision, Parcel No. 7 (Revised), a subdivision according to the map or plat thereof on file and of record in the office of the Chancery Clerk in the Second Judicial District of Harrison County, Mississippi, in Plat Book 23, at Page 19 (Copy Book 5, at Page 3). Commonly known as 318 Eastview Drive, Biloxi, MS 39531. I WILL CONVEY ONLY such title as is vested in me as Substituted Trustee without warranty whether expressed or implied.
