Ordinance Amending Modesto's Municipal Code Establishing Regulations and Requirements for Smoke Shops, Including Permitting and Enforcement,

A public hearing will be held by the City Council of the City of Modesto at 5:30 pm on Tuesday, July 22, 2025, via livestream through a link on modestogov.com and in Chambers, at 1010 Tenth Street, Modesto, California, regarding a proposed City Ordinance amending Modesto's Municipal Code establishing regulations and requirements for Smoke Shops, including permitting and enforcement, within the City. The Ordinance will provide location restrictions, operating standards, permitting requirements, and enforcement provisions. The proposed Ordinance will also require existing Smoke Shops to comply with certain conditions to be eligible to receive a Smoke Shop Permit, but existing Smoke Shops will not be subject to location restrictions. All Smoke Shops will be required to obtain a Smoke Shop Permit in order to operate in the City of Modesto.
This proposed Ordinance was heard at a Public Hearing of the City of Modesto Planning Commission on June 2, 2025 and was recommend by a unanimous 5-0 vote to forward this matter to the City Council for consideration and approval.
All interested persons are invited to attend the Public Hearing at the above time and place or via livestream and may participate in the public hearing by submitting your comment via email to ccmeetings@modestogov.com or will be given the opportunity to be heard if attending the meeting in person.
If you challenge the proposed action in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice or in written correspondence delivered to the City Council at or prior to the public hearing.
