COUNTY OF MUSCOGEE
Under and by virtue of the Power of Sale contained in a certain Deed to Secure Debt from Kenneth B. Walker Residential Home, Inc. a Georgia nonprofit corporation, to Southern States Bank now known as Southern States Bank, A Division of FirstBank of Nashville, Tennessee ( being identified hereinafter as the "Lender") being dated October 24, 2018 and being recorded on October 25, 2018 in Deed Book 12495, beginning at page 3 in the office of the Clerk of the Superior Court, Muscogee County, Georgia, and thereafter being modified by that certain Modification of Security Deed dated February 28, 2024 and recorded on February 28, 2024 in Deed Book 14348, beginning at page 105 in the office of the Clerk of the Superior Court, Muscogee County, Georgia (with the Deed to Secure Debt and the Modification of Security Deed identified herein being hereinafter collectively referred to as the 'Security Deed") and given by Kenneth B. Walker Residential Home, Inc to secure the payment and performance of Kenneth B. Walker Residential Home, Inc.'s obligations to the Lender, that include a certain promissory note originally dated October 24, 2018 (hereinafter the "Note") in the original principal amount of $1,802,000.00, with interest thereon, there will be sold by the undersigned at public outcry during the legal hours of sale before the doors of the county courthouse in Columbus, Muscogee County, Georgia, on the first Tuesday in August 2025, to-wit: August 5, 2025, to the highest and best bidder for cash, all property, property rights or interests described in, and being conveyed by, the Security Deed, including, but not necessarily limited to, the following described real property:
All that tract or parcel of land situate, lying and being in Land Lot 113 of the Coweta Reserve, Columbus, Muscogee County, Georgia, and being known and designated as "4.0 ACRES +/-" on that certain map or plat entitled "Replat of Section Two, Columbus Auto Center, Part of Land Lot 113, Coweta Reserve, Columbus, Muscogee County, Georgia," as prepared by Ennis & Company, Inc. under date of September 27, 1973, and being recorded at Plat Book 55, Page 58, of the records in the Office of the Clerk of the Superior Court of Muscogee County, Georgia, reference to said map or plat is made for a more particular metes and bounds description of the property. Said property is presently assigned street address of 1452 Box Circle, Columbus, Georgia 31907 according to the present system of numbering dwellings in Muscogee County, Georgia.

This is the identical real property conveyed to Kenneth B. Walker Residential Home, Inc. a Georgia nonprofit corporation by virtue of that certain Limited Warranty Deed from Foundation Properties, Inc., a Georgia nonprofit corporation, dated December 19, 2016, and recorded December 20, 2016, in Deed Book 11990, Page 303, of the records in the Office of the Clerk of the Superior Court of Muscogee County, Georgia.
Together with all rights, easements appurtenances, royalties, mineral rights, oil and gas rights, crops, timber, including timber to be cut now or at any time in the future, all diversion payments or third party payments made to crop producers, all water and riparian rights, wells, ditches, reservoirs and water stock and all existing and future improvements, structures, fixtures, and replacements that may now, or at any time in the future, be part of the real estate described( all referred to as Property). This Security Deed shall remain in effect until the secured debts and all underlying agreements( as identified or described in the Security Deed) have been terminated in writing by the Lender.
A default has occurred under the terms of the Note. The default includes, among other possible events of default, the failure to maintain or pay the Note's payments when due, and as required by the terms of the Note and Security Deed. The indebtedness evidenced by the Note has been accelerated and declared immediately due and payable in full by the Lender and, as maybe be now necessary or required, is hereby accelerated and declared by Lender, to be immediately due and payable in full. The indebtedness remaining in default, this sale will be made for the purpose of applying the proceeds thereof to the payment of the indebtedness evidenced by the Note including, but not limited to, the costs and expenses of collection of the Note, attorney's fees (notice of the intention to collect attorney's fees having been provided to Kenneth B. Walker Residential Home, Inc.), accrued interest and expenses of the sale and all other amounts, payments, fees, costs or expenses as originally and continuously provided for under the Note and Security Deed, or as provided by applicable law. Any remainder shall be paid or applied as provided for by law. In accordance with O.C.G.A. §44-14-162.2, the name, address and telephone number of the entity or individual with the full authority to negotiate, amend or modify the terms of the Note and Security Deed is Southern States Bank, A Division of FirstBank of Nashville, Tennessee, Special Assets Department, 5604 Whittlesey Blvd., Columbus, Georgia, 31909. Please note that O.C.G.A §44-14-162.2 does not require that Southern States Bank, A Division of FirstBank of Nashville, Tennessee, to negotiate, amend or modify the terms of the Note or Security Deed.
This sale will be conducted subject to confirmation that the sale is not prohibited under the United States Bankruptcy Code and to the final confirmation and audit of the status of the Note and Security Deed referenced above and herein.
THIS COMMUNICATION IS FROM A DEBT COLLECTOR WHO IS ATTEMPTING TO COLLECT A DEBT AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
Upon the information and belief of the undersigned, the Property is in the possession of the Kenneth B. Walker Residential Home, Inc. with certain occupants or tenants possibly present and/or residing therein. In any event, the Property will be sold as the property of Kenneth B. Walker Residential Home, Inc. and will further be sold "as is" "where is" and without warranty (express or implied) or recourse or representations of any kind or nature whatsoever. The Property will be sold subject to prior or superior liens and encumbrances as well as prior deeds to secure debt of record, if any, outstanding and applicable ad valorem taxes (whether or not now due and payable), zoning ordinances, street improvements, special assessments, liens, covenants, rights of way, easements, restrictions or other matters of record, if any, and any matters that would be disclosed or determined by a survey or an inspection of the Property. The undersigned will execute a deed to the purchaser of the Property at the sale as provided in the Security Deed.
