SOUTH CAROLINA DEPARTMENT OF ENVIRONMENTAL SERVICES Bureau of Land and Waste Management Notice of Department Decision Topic: Proposed Replacement of the Calhoun County Class 2 Landfill Location: Access Road, Gaston, South Carolina The South Carolina Department of Environmental Services has made a final decision that the proposed replacement of the Calhoun County Class 2 Landfill is consistent with the requirements of the DON regulations, the Three Rivers and state solid waste management plans as a commercial landfill, and the buffer requirements. The Department also confirmed receipt of a zoning approval letter. Notice of this decision can be found on the Department's website at: https://des.sc.gov/community/community-engagement/environmental-public-notices This decision becomes the final agency decision thirty (30) days from the date of the mailing of the decision (August 6, 2025) unless an appeal is made in accordance with S.C. Code Ann. § 48-6-30(D)(2), which states: Within thirty calendar days after the mailing of a decision [pursuant to S.C. Code Ann.§ 48-6-30(D)(1)], an applicant, permittee, licensee, certificate holder, or affected person desiring to contest the department decision may request a contested case hearing before the Administrative Law Court, in accordance with the Administrative Procedures Act.
