NOTICE OF PUBLICATION TO WHOM IT MAY CONCERN: An act for the relief of Jose Correa by Miami-Dade County; providing for an appropriation to compensate Jose Correa for injuries and damages sustained by Jose Correa as a result of the negligence of Miami-Dade County; providing a limitation on the payment of attorney fees; providing an effective date. WHEREAS, on December 16, 2021, Jose Correa was lawfully walking across Bird Road (SW 40th Street) at the intersection of Bird Road and LeJuene Road (SW 42nd Avenue) in Miami-Dade County. Jose Correa was crossing the street in the marked crosswalk of the intersection, and WHEREAS, the Miami-Dade County bus operator failed to observe Jose Correa and made a left hand turn at the intersection causing a collision between the bus and Jose Correa, and WHEREAS, Jose Correa has alleged, through a lawsuit filed on July 21st, 2022, that the negligence of Miami-Dade County, through its bus driver, was the proximate cause of the injuries to Jose Correa, and WHEREAS, Jose Correa suffered significant personal injuries, including but not limited to, a below knee amputation. Jose Correa has suffered significant medical bills in the past and will endure medical bills and medical care for the remainder of his life, and WHEREAS, Jose Correa suffered significant pain and suffering in the past and will continue to suffer pain and suffering for the remainder of his life, and WHEREAS, Jose Correa have reached a compromised settlement in the amount of $4,300,000.00, and WHEREAS, pursuant to the agreement between the parties, the settlement will be partially satisfied in the amount of $200,000, and WHEREAS, pursuant to the settlement, the claim shall be considered fully satisfied by payment of an additional $4,100,000 by Miami-Dade County to Jose Correa, as authorized by the Florida Legislature, NOW, THEREFORE, Be It Enacted by the Legislature of the State of Florida: Section 1. The facts stated in the preamble to this act are found and declared to be true. Section 2. Miami-Dade County is authorized and directed to appropriate from funds not otherwise encumbered and to draw a warrant in the sum of $4,100,000 payable to Jose Correa as compensation for injuries and damages sustained. Section 3. The amount paid by Miami-Dade County pursuant to s. 768.28, Florida Statutes, and the amount awarded under this act are intended to provide the sole compensation for all present and future claims arising out of the factual situation described in this act which resulted in Jose Correa's injuries and damages. The total amount paid for attorney fees may not exceed 25 percent of the monies awarded under this act. However, taxable costs, which may not include attorney's fees and lobbying fees, related to the underlying civil action may be collected in addition to the aforementioned attorney's fees and lobbying costs.
