NOTICE OF SALE UNDER POWER By virtue of the power of sale contained in that certain deed to secure debt, assignment of leases and rents, fixture filing, and security agreement given by Empson Investments, LLC ("Borrower") to DLP Lending Fund, LLC (together with its successors and assigns, "Lender") dated June 7, 2021 filed for record June 10, 2021, in Deed Book 13438, Page 222, in the Muscogee County, Georgia Records (collectively, as modified, amended, and assigned, the "Deed to Secure Debt"), said Deed to Secure Debt having been given to secure indebtedness in the amount of Two Hundred Fifty-Five Thousand and No/100 Dollars ($255,000.00), there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door of Muscogee County, Georgia, or at such place as may be lawfully designated as an alternative, between the hours of 10:00 a.m. and 4:00 p.m. on August 5, 2025, the following described property: Parcel 1: All that lot, tract and parcel of land situate, lying and being in Muscogee County, Georgia, being known and designated as ALL OF LOT NUMBERED TEN (10), BLOCK NUMBERED SEVEN (7), ROSE HILL HEIGHTS, as said lot is shown upon a map or plat of said Subdivision recorded in Plat Book 1, Page 36, in the Office of the Clerk of the Superior Court of Muscogee County, Georgia, to which reference is made for a more specific location and dimensions of said lot. The improvements thereon being known as 3812 13th Avenue, Columbus, Georgia - 31907. Parcel 2: All that lot, tract or parcel of land situate, lying and being in the City of Columbus, Muscogee County, Georgia, and being known and designated as all of Lot Numbered 26, in Block Lettered "B", in what is known as EVANS MANOR SUBDIVISION, as said Lot appeared on a map or plat of said subdivision recorded in the Office of the Clerk of the Superior Court of Muscogee County, Georgia, in Deed Book 93, Page 137, and, upon which is located dwelling Number 1534 30th Street. The improvements thereon being known as 1534 30th Street, Columbus, Georgia - 31907. The debt secured by the herein described Deed to Secure Debt has been declared due because of, among other possible events of default, failure to pay the indebtedness when due and in the manner provided in the under the documents secured by the Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorneys' fees. The entity that has full authority to negotiate, amend, and modify all terms of the Deed to Secure Debt with the debtor is DLP Lending Fund, LLC, 405 Golfway W Dr, St. Augustine, FL 32095, Attention: Noah Rodriguez, (904) 201-1735. Please understand that the secured creditor is not required to negotiate, amend, or modify the terms of the Deed to Secure Debt. Said property will be sold subject to any outstanding ad valorem taxes (including taxes that are a lien, but not yet due and payable); matters that may be disclosed by an accurate survey and/or inspection of the property; all assessments, liens, encumbrances, zoning ordinances, easements, covenants, and restrictions; and any matters of record superior to this Deed to Secure Debt.
