NOTICE OF SALE UNDER POWER MUSCOGEE COUNTY, GEORGIA Because of default in the payment of the indebtedness, secured by that certain Deed to Secure Debt, Assignment of Rents and Security Agreement from COLUMBUS CREEK HOLDINGS, LLC ("Borrower") to ABL RPC Residential Credit Acquisition LLC ("Secured Creditor"), recorded at Deed Book 14445, Page 59, Muscogee County, GA records, and re-recorded at Deed Book 14493, Page 61 aforesaid records (the "Security Deed") Secured Creditor pursuant to said deed and the note thereby secured, has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in said deed, and pursuant to O.C.G.A Section 9-13-161(a) will on the first Tuesday in August 2025, during the legal hours of sale, at the Courthouse door in MUSCOGEE County, Georgia, sell at public outcry to the highest bidder for cash, the property described in said deed to wit: ALL THAT TRACT OR PARCEL OF LANDLYING AND BEING IN LAND LOT 84 OF THE 8TH DISTRICT, MUSCOGEE COUNTY, GEORGIA, BEING BLOCK 1200 OF COLUMBUS CREEK TOWNHOMES SUBDIVISION AS PER PLAT THEREOF RECORDED IN PLAT BOOK 167, PAGE 268, MUSCOGEE COUNTY, GEORGIA RECORDS, WHICH RECORDED PLAT IS INCORPOATED HEREIN BY REFERENCE AND MADE A PART OF THIS DESCRIPTION. ALSO CONVEYED HEREWITH IS AN EASEMENT FOR INGRESS AND EGREE FOR THE VENEFIT OF GRANTEE, ITS SUCCESSOR AND ASSIGNS, OVER THAT PROPERTY DESRIBED AS "DRIVEWAY EASEMENT AREA," "UTILITY CONSTRUCTION EASEMENT AREA," "ROADWAY CONSTRUCTION EASEMENT AREA" AND "40' ACCESS & UTILITY EASEMENT" AS SHOWN ON THAT CERTAIN FINAL PLAT OF COLUMBUS CREEK TOWNHOMES, DATED NOVEMBER 20, 2023, FILED NOVEMBER 30, 2023, AND RECORDED IN PLAT BOOK 167, PAGE 268, MUSCOGEE COUNTY, GEORGIA REOCRDS, FOR THE PURPOSE OF PROVIDING GRANTEE ACCESS TO THE ABOVE DESCRIBED PROPERTY FROM RIVER ROAD (130' PUBLIC RIGHT OF WAY). SAID EASEMENT SHALL RUN WITH THE LAND AND BE BINDING ON GRANTOR, ITS SUCCESSORS AND ASSIGNS, AND SHALL ONLY TERMINATE UPON THE FULL PAYMENT AND SATISFACTION OF THE INDEBTEDNESS AS DESCRIBED BY THIS SECURITY DEED, AND THE RECORDING OF A CANCELLATION OF THIS SECURITY DEED IN THE DEED RECORDS OF THE SUPERIOR COURT OF MUSCOGEE COUNTY, GEORGA. together with all fixtures and other personal property conveyed by said deed. The sale will be held subject to any unpaid taxes, assessments, rights-of-ways, easements, protective covenants or restrictions, liens, and other superior matters of record which may affect said property. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed. Notice has been given of intention to collect attorney's fees in accordance with the terms of the note secured by said deed. To the best knowledge and belief of the undersigned, the party (or parties) in possession of the subject property is: COLUMBUS CREEK HOLDINGS, LLC, and/or tenant or tenants and the proceeds of said sale will be applied to the payment of said indebtedness, the expense of said sale, all as provided in said deed, and the undersigned will execute a deed to the purchaser as provided in the aforementioned Security Deed.
