NOTICE TO BIDDERS
Sealed proposals for the work shown on the plans entitled: Max Foster Multiuse Path – Phase 1, Federal-Aid Project No. CML-5256(020) and Max Foster Multiuse Path – Phase 2, Federal-Aid Project No. CML-5256(021) will be received at the office of the City Clerk of the City of Livingston, 1416 C Street Livingston, CA 95334 until 2:00 p.m. PDT on July 30, 2025, at which time they will be publicly opened and read aloud.
The major work consists of constructing a concrete multiuse path along Dwight Way and Walnut Avenue in the City of Livingston. The work also includes curb and gutter, an AC pavement conform section, driveways, curb cut ramps, landscaping, and landscape irrigation.
The time for completion is sixty (60) working days to complete both projects.
The DBE Contract goal is 15% for Federal-Aid Project No. CML-5256(020) and 15% for Federal-Aid Project No. CML-5256(021).
The City of Livingston affirms that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation.
THIS PROJECT IS SUBJECT TO THE "BUY AMERICA" REQUIREMENTS.
Prospective Bidders are required to attend a mandatory pre-bid meeting at 10:00 a.m., July 9, 2025, at Livingston City Hall, located at 1416 C Street Livingston, CA 95334. This meeting is to inform bidders of project requirements and subcontractors of subcontracting and material supply opportunities.
Bids will not be considered from Bidders who were not physically in attendance at the mandatory pre-bid meeting.
In accordance with the provision of Section 3300 of the Public Contract Code, at the time this contract is awarded, the Contractor shall possess a Class A or C-8 California State Contractor's License. Bids are required for the entire work described herein.
The Contractor and Subcontractors must have a valid Unique Entity ID (UEI) number.
This contract is subject to state contract nondiscrimination and compliance requirements pursuant to Government Code, Section 12990.
Pursuant to Section 1773 of the Labor Code, the general prevailing wage rates in the county, or counties, in which the work is to be done have been determined by the Director of the California Department of Industrial Relations. These wages are set forth in the General Prevailing Wage Rates for this project, available from the California Department of Industrial Relations' Internet web site at http://www.dir.ca.gov/DLSR/PWD. Future effective general prevailing wage rates, which have been predetermined and are on file with the California Department of Industrial Relations are referenced but not printed in the general prevailing wage rates.
This project requires compliance with the Davis Bacon Act and adherence to the current U.S. Department of Labor Wage Decision. The Federal minimum wage rates for this project as predetermined by the United States Secretary of Labor are available at https://sam.gov/ and are not included in copies of this book. Addenda to modify the Federal minimum wage rates, if necessary, will be issued to holders of Bid book.
Bidders are notified that the higher of either the Davis-Bacon or the State prevailing wage rate shall apply.
No contractor or subcontractor may be listed on a bid proposal or be awarded a contract for public work on a public works project unless registered with the Department of Industrial Relations pursuant to Labor Code Section 1725.5.
This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations.
Each proposal shall be accompanied by cashier's or certified check, or by an original bidder's bond, made payable to the City of Livingston and executed as surety by some corporation authorized to issue surety bonds in the State of California, for an amount equal to at least ten percent (10%) of the amount of said bid and no bid shall be considered unless such cashier's or certified check, or an original bidder's bond in enclosed therewith.
