NOTICE OF SUBSTITUTED TRUSTEE'S SALE
WHEREAS, on May 11, 2018, a Deed of Trust, Security Agreement, Financing Statement and Assignment of Rents was executed by Kenneth R. Borries, 3300 Oak Street, Gautier, MS 39553, to H.E. Smith, Trustee for the benefit of Merchants & Marine Bank, 3118 Pascagoula Street, Pascagoula, MS 39567, (228) 762-3311, recorded as Instrument No. 201821736 in Deed of Trust Book 3546, Pages 155-161, Records of Mortgages and Deeds of Trust of Jackson County, Mississippi; and
WHEREAS, on June 3, 2021, a Deed of Trust was executed by Kenneth Roy Borries, 3300 Oak Street, Gautier, MS 39553, to H. E. Smith, Trustee for the benefit of Merchants & Marine Bank, 3118 Pascagoula Street, Pascagoula, MS 39567, (228) 762-3311, recorded as Instrument No. 202117921 in Deed of Trust Book 3810, Pages 154-169, Records of Mortgages and Deeds of Trust of Jackson County, Mississippi.; and
WHEREAS, Merchants & Marine Bank, appointed Nicole W. Sullivan of Sullivan Law Firm, PLLC, as Substituted Trustee in said Deed of Trust, Security Agreement, Financing Statement and Assignment of Rent, in place of H.E. Smith or any other Trustee, substituted heretofore, by Appointment of Substitute Trustee dated March 25, 2025, recorded as Instrument No. 202505103 in Deed of Trust Book 4138, Pages 180-182, Records of Mortgages and Deeds of Trust in Jackson County, Mississippi; and
WHEREAS, default having being made in the terms and conditions of said Deeds of Trust, Security Agreements, Financing Statements and Assignment of Rents, and the entire debt secured thereby, having been declared to be due and payable in accordance with the terms of said Deeds of Trust, Security Agreements, Financing Statements and Assignment of Rents to Merchants & Marine Bank, and the legal holder of said indebtedness, MERCHANTS & MARINE BANK, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said Deeds of Trust, Security Agreements, Financing Statements and Assignment of Rents, for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expenses of sale;
NOW, THEREFORE, I, Nicole W. Sullivan, of Sullivan Law Firm, PLLC, Substituted Trustee in said Deed of Trust, Security Agreement, Financing Statement and Assignment of Rents, will on the 23rd day of July, 2025, offer for sale at public outcry, to the highest bidder for cash, within the legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the main West front door of the Jackson County Courthouse, 3104 Magnolia Street, in the City of Pascagoula, Jackson County, Mississippi, the following described situated in the County of Jackson, State of Mississippi, to-wit:
That certain tract, piece or parcel of land situated in Section 7, Township 7 South, Range 6 West, Jackson County, Mississippi, and being more particularly described as follows, to-wit: Commencing at the Northwest corner of Claim Section 7, Township 7 South, Range 6 West, thence run East 1163.2 feet to a point; thence run South 1094.0 feet to a ½" iron pipe; from said pipe; run North 89 degrees 58 minutes 54 seconds East 438.64 feet to a ½" iron rod; from said iron rod, run South 12 degrees 8 minutes 32 seconds West 172.48 feet to a fence post and the POINT OF BEGINNING; from said point run North 77 degrees 13 minutes 57 seconds West 211.62 feet along a fence to a fence post; thence run South 10 degrees 39 minutes 14 seconds West 143.36 feet along a fence to a fence post; thence run North 69 degrees 44 minutes 11 seconds West 195.62 feet along a fence to a fence post and the apparent East margin of a 50 foot right-of-way public road per Deed Book 1003, Page 211; from said post run South 01 degrees 28 minutes 42 seconds West 329.68 feet along said East margin of road to a set iron rod and the apparent North margin of Borries Road; thence run South 85 degrees 44 minutes 47 seconds East 143.6 feet along the said North margin of Borries Road to a set iron rod; thence run South 88 degrees 13 minutes 34 seconds East 407.266 feet along said North margin of Borries Road to a set iron rod and the apparent West margin of Dead River Road; thence run North 04 degrees 25 minutes 22 seconds East 224.54 feet along said West margin of Dead River Road to a set iron rod; thence run North 85 degrees 53 minutes 38 seconds West 111.24 feet along a fence to a fence post; thence run North 12 degrees 08 minutes 32 seconds West 150.72 feet along a fence to the POINT OF BEGINNING.
LESS AND EXCEPT: A parcel of land located in Claim Section 7, Township 7 South, Range 6 West, Jackson County, Mississippi, being more particularly described as: Commencing at the Northwest corner of said Claim Section 7; thence run East for 1163.2 feet to a point; thence run South for 1094.0 feet to an existing iron pipe; thence run North 89 degrees 58 minutes 54 seconds East for 418.19 feet to the POINT OF BEGINNING; thence run South 12 degrees 08 minutes 32 seconds East for 342.51 feet to a point; thence run South 85 degrees 53 minutes 38 seconds East for 126.13 feet to the westerly margin of Dead River Road; thence run North 04 degrees 25 minutes 22 seconds East along the said westerly margin, 20 feet to an iron rod; thence run North 85 degrees 53 minutes 38 seconds West along a fence line and the South line of the property described and delineated at Deed Book 1054, Page 455, for 111.24 feet to fence post; thence run North 12 degrees 08 minutes 32 seconds West along a fence and an extension thereof, and along the westerly line of said property described at Deed Book 1054, Page 455 for 323.2 feet to an existing iron rod marking the northwesterly corner of said Deed Book and Page; thence run South 89 degrees 54 seconds West for 20.45 feet to the POINT OF BEGINNING.
