Under and by virtue of the power of sale in a certain Deed to Secure Debt from BSW AUTO SALES, LLC, Grantor, to MORRIS BANK, Grantee, dated the 25th day of March, 2022 and recorded in Deed Book 11202, Page 28-37, Clerk's Office, Bibb County Superior Court, said Deed to Secure Debt having been given to secure 1) a Note dated the 25th day of March, 2022 in the sum of $172,000.00, and 2) an additional Note dated the 21st day of September, 2022 in the sum of $126,883.78, there is due to be sold by the undersigned at public outcry, during the legal hours of sale on the first Tuesday in August, 2025, to-wit: the 5th day of August, 2025, to take place at the United Building in Central City Park located at 206 7th Street, Macon, Bibb County, Georgia, to the highest and best bidder for cash, the following described property: ALL THAT TRACT OR PARCEL OF LAND lying and being in the City of Macon, Bibb County, Georgia and being more particularly known and designated as Lots 15 and 16 of Block 5 of Bellevue according to a plat which appears of record in Deed Book 68, Folio 720, Clerk's Office of Bibb Superior Court. Said plat is referred to for the purpose of a more complete and accurate description of said property and is incorporated herein by reference thereto. Said property has situate thereon buildings known as 3737-3739 and 3731 Napier Avenue, Macon, GA.
TRACT ONE: All that tract or parcel of land situate, lying and being in Bibb County, Georgia, in the City of Macon, being known and distinguished as Lot No. 19 of Block 5 of Bellevue Subdivision, being more particularly described according to plat of record in Plat Book 68, Page 720, Clerk's Office, Superior Court, which said plat is by this reference thereto incorporated herein for the purpose of a more particular and accurate description of said Lot No. 19 hereby conveyed. Said Lot No. 19, Block No. 5 of Bellevue Subdivision more particularly described according to said last mentioned plat fronting a distance of 70 feet on the easterly right of way on Napier Avenue and extending back therefrom in an easterly direction with, even width, for a distance of 208 and ½ feet more or less to a 12-foot alley along the rear of the subject property. There are improvements located thereon known under the present system of numbering as 3725 Napier Avenue, Macon, Bibb County, Georgia. The property hereinabove described and conveyed is designated as Parcel No. 3 in a Deed from Tommy Luther Griffin to L.S.D. Properties, LLLP dated December 29, 1997 and recorded in Deed Book 4090, Page 164, Clerk's Office, Bibb Superior Court. Reference is hereby made to the above described plat and deed for the purpose of a more particular and accurate description of the property hereby conveyed.
TRACT TWO: All that tract or parcel of land situate, lying and being in Bibb County, Georgia, in the City of Macon, being known and distinguished as Lot No. 10 of Block 5 of Bellevue Subdivision, being more particularly described according to plat of record in Plat Book 68, Page 720, Clerk's Office, Bibb Superior Court, which said plat is by this reference thereto incorporated herein for the purpose of a more particular and accurate description of said Lot No. 10 hereby conveyed. Said Lot 10 of Block 5 of Bellevue Subdivision more particularly described according to said last mentioned plat as fronting a distance of 70 feet on the easterly right of way of Napier Avenue and extending back therefrom in an easterly direction, with even width, for a distance of 208 and ½ feet more or less to a 12 foot alley located along the rear of the subject property. The property hereinabove described and conveyed is the same and identical property described as Parcel No. 2 in a deed from Tommy L. Griffin to L.S.D. Properties, LLLP dated December 29, 1997 and recorded in Deed Book 4090, Page 164, Clerk's Office, Bibb Superior Court. Reference is hereby made to the above described plat and deed for the purpose of a more particular and accurate description of the property hereby conveyed.
The debts secured by said Deed to Secure Debt and Notes have been and are hereby declared due and payable in full because of default pursuant to the terms of said Deed to Secure Debt and notes. Notice has been given to enforce provisions for collection of attorney's fees and foreclosure in accordance with the legal requirements and the terms of the Deed to Secure Debt and Notes. The indebtednesses remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtednesses secured by the Deed to Secure Debt, accrued interest and expenses of the sale and other sums secured by the Deed to Secure Debt, including the attorney's fees and the remainder, after applying said proceeds to other indebtednesses owed by Grantor to Grantee, if any, shall be applied as provided by law.
To the best of the undersigned's knowledge and belief, the property is in the possession of BSW AUTO SALES, LLC and said property will be sold as the property of BSW AUTO SALES, LLC. Said property will also be sold subject to all outstanding ad valorem taxes, street improvements, and easements or restrictions of record, if any, unpaid water or sewage bills that constitute a lien against the property whether due and payable or not yet due and payable and which may not be of record, the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, and any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to the Deed to Secure Debt first set out above. The undersigned will execute a deed to the purchaser at said sale as provided in the Deed to Secure Debt. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Deed to Secure Debt.
