NOTICE OF FORECLOSURE SALE UNDER POWER MUSCOGEE COUNTY, GEORGIA Under and by virtue of the Power of Sale contained in a Security Deed given by Chavis Bell and Phenequia Smith to Mortgage Electronic Registration Systems, Inc., as grantee, as nominee for Taylor, Bean & Whitaker Mortgage Corp., dated May 24, 2007, and recorded in Deed Book 8692, Page 180, Muscogee County, Georgia Records, subsequently modified by a Loan Modification Agreement recorded October 30, 2013 in Book 11099, Page 194 in the amount of One Hundred Sixty-One Thousand Six Hundred Nine and 55/100 ($161,609.55) Muscogee County, Georgia Records, subsequently modified by a Loan Modification Agreement recorded January 20, 2016 in Book 11722, Page 63 in the amount of One Hundred Seventy-Four Thousand One Hundred Seventy-Six and 81/100 ($174,176.81) Muscogee County, Georgia Records, subsequently modified by a Loan Modification Agreement recorded October 26, 2018 in Book 12496, Page 8 in the amount of One Hundred Twenty-Seven Thousand Sixty-One and 36/100 ($127,061.36) Muscogee County, Georgia Records, subsequently modified by a Loan Modification Agreement recorded March 19, 2024 in Book 14364, Page 130 in the amount of One Hundred Twenty-Three Thousand Eighty-Six and 87/100 ($123,086.87) Muscogee County, Georgia Records, as last transferred to Selene Finance LP by assignment recorded on April 8, 2015 in Book 11497 Page 141 in the Office of the Clerk of Superior Court of Muscogee County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of One Hundred Forty-Two Thousand Six Hundred Twelve and 0/100 dollars ($142,612.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Muscogee County, Georgia, within the legal hours of sale on August 5, 2025, the following described property: All that lot, tract and parcel of land situate, lying and being in Columbus, Muscogee County, Georgia, and being known and designated as ALL OF LOT NUMBERED ONE (1), IN BLOCK LETTERED "A", of that subdivision of land known as BROOKWOOOD, as said lot is shown on a map or plat of said Subdivision entitled "Final Plat of Brookwood Subdivision Lying in Part of Land Lot 23, 9th Land District, Columbus, Muscogee County, Georgia," dated February 4, 2005, prepared by F. Wayne Allen, and recorded in Plat Book 153, Page 112, in the Office of the Clerk of the Superior Court of Muscogee County, Georgia, and reference is made to said map or plat for the most particular location and dimensions of said lot. Located on said property is dwelling numbered 5769 Glenmere Drive, according to the present system of numbering dwellings in Columbus, Muscogee County, Georgia. The above described property is conveyed together with and/or subject to all valid and enforceable easements and restrictions of record and all zoning ordinances applicable thereto. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. To the best knowledge and belief of the undersigned, the party in possession of the property is Chavis Bell and Phenequia Smith or tenant(s); and said property is more commonly known as 5769 Glenmere Dr, Columbus, GA 31907.
