NOTICE OF JUDICIAL FORECLOSURE SALE
WHEREAS, Noal Robert Rossow and wife Claire E. Rossow ("Grantors") executed a Deed of Trust dated November 23, 2009 to T. Harris Collier, III, as Trustee, for the benefit of Trustmark National Bank ("Beneficiary"), and said Deed of Trust was recorded on December 1, 2009 at Book 2863, Page 242, Instrument No. 200923244, in the registry of the Chancery Clerk of Jackson County, Mississippi ("Land Records") being secured by all that land and real property described therein and below and the same being located at 3024 Ridgedale Road, Gautier, Jackson County, Mississippi (the "Property");
WHEREAS, Noal Robert Rossow died testate on August 13, 2021;
WHEREAS, Noal Robert Rossow was predeceased by his wife, Claire E. Rossow, who died on or about January 7, 2016;
WHEREAS, at the time of his death, Noal Robert Rossow was the sole owner of the Property;
WHEREAS, on or about September 22, 2021, Terri Rossow Billingsley as Executrix for the Estate of Noal Robert Rossow filed a Petition for Probate of Will, for Establishment of Heirs, and for Letters Administratrix;
WHEREAS, in In re the Last Will and Testament of Noal Robert Rossow, in the Chancery Court of Jackson County, Mississippi, Civil Action No. 21-cv-1848-DNH (the "Litigation"), the Chancery Court of Jackson County ordered title to the Property be vested in the heirs of Noal Robert Rossow: Terri Rossow Billingsley; William Rossow; Daniel Rossow; Charles Rossow; Cheryl A. Sevinsky; and Jenifer L. Rossow Warner.
WHEREAS, on August 23, 2024, the Chancery Court of Jackson County entered in the Litigation the Final Judgment Granting Trustmark National Bank's Petition for Judicial Foreclosure [Doc. No. 162] ("Final Judgment"), finding that the Beneficiary has a valid and subsisting first mortgage lien on the Property which has priority over any and all other interests, liens and claims in the Property, or otherwise that such liens, claims or interest are subordinate to the liens, claims and interest of Beneficiary in such Property;
WHEREAS, the Final Judgment has been recorded by the Chancery Clerk of Jackson County, Mississippi in the official land records of Jackson County, Mississippi as Instrument No. 202506304 in Book 2206 at Page 152;
WHEREAS, the legal holder of the aforesaid Deed of Trust and the indebtedness secured thereby substituted Alston F. Ludwig, as Substitute Trustee, in the place and stead of T. Harris Collier, III, by Appointment of Substitute Trustee recorded on April 19, 2024, at Book 4062, Page 810, Instrument No. 202406713 in the Land Records;
WHEREAS, in the Final Judgment, the Chancery Court of Jackson County determined that the terms and conditions of said Deed of Trust were in default, and ordered that the entire indebtedness secured thereby was due and payable in accordance with the terms of said Deed of Trust;
WHEREAS, in the Final Judgment the Chancery Court of Jackson County, Mississippi ordered that the Beneficiary commence judicial foreclosure proceedings to liquidate the Property.
WHEREAS, the Chancery Court of Jackson County has appointed the Substitute Trustee as Commissioner and ordered the Commissioner to commence the foreclosure sale of said Property on behalf of the Beneficiary;
WHEREAS, upon the sale of the Property to the highest and best bidder, the sale shall be confirmed by the Chancery Court of Jackson County at a hearing to take place immediately following the judicial foreclosure sale;
NOW, THEREFORE, I, Alston F. Ludwig, Substitute Trustee and Commissioner, will on the 17th day of July, 2025, offer for sale, at public outcry, and sell during legal hours, being between the hours of 11:00 a.m., and 4:00 p.m., at the front main entrance of the Jackson County Chancery Courthouse located at 3104 Magnolia Street, Pascagoula, Mississippi 39567, for cash, to the highest and best bidder, the following described Property, together with all improvements thereon, situated in Jackson County, Mississippi:
That tract, piece or parcel of land situated in Section 36, Township 7 South, Range 7 West, Jackson County, Mississippi, being more particularly described as follows, to-wit:
Commencing at a point where the South right-of-way line of Old U. S. Highway 90 intersects the Range Line between Township 7 South, Range 6 West, end Township 7 South, Range 7 West; thence run Westerly and along the said South right-of-way line of Old U. S. Highway 90 a distance of 1225.0 feet; thence run South a distance of 710.0 feet to a point on the South right-of-way line of a County Road running East and West; thence West along the South boundary of said County Road a distance of 225 feet to a point at the Southeast intersection of two County Roads; thence South along the East boundary of a dirt County Road 100 feet to the point of beginning of the property herein conveyed; thence East 125 feet to the West boundary line of the property previously conveyed to Abner Hutchins; thence South along the West boundary line of said Hutchins property a distance of 65 feet; thence West 125 feet to the East boundary of a dirt County Road; thence North along the dirt County Road a distance of 65 feet to the point of beginning of the property herein conveyed

Highway 90 intersects the Range Line between Township 7 South, Range 6 West, and Township 7 South, Range 7 West; thence run Westerly and along the said South right-of-way line of Old U. S. Highway 90 a distance of 1225.0 feet; thence run South a distance of 710.0 feet to a point on the South right-of-way line of a County Road running East and West; thence West along the South boundary of said County Road a distance of 225 feet to a point at the Southeast intersection of two County Roads; thence South along the East boundary of a dirt County Road 100 feet to an iron pin; thence East 125 feet to an iron pipe on the West boundary line of the property previously conveyed to Abner Hutchins; thence South along the West boundary line of said Hutchins property a distance of 65 feet to a fence post and the Point of Beginning; from said point of beginning run thence South a distance of 5 feet; run thence West a distance of 125 feet to the East boundary of a dirt County Road; run thence North along the dirt County Road a distance of 5 feet; run thence East a distance of 125 feet back to the point of beginning of the property herein conveyed
Title is believed to be good, but I will convey only such title as is vested in me as Commissioner.
The sale of all property shall be "as is", "where is," and without any warranty of any kind.
