NOTICE OF PUBLIC HEARING BEFORE THE CITY COUNCIL
ON THE CONTINUATION OF THE LEVY OF ANNUAL ASSESSMENTS
OF CITY OF LIVINGSTON BENEFIT ASSESSMENT DISTRICTS
FOR FISCAL YEAR 2025/2026
Notice is hereby given that on the 1st day of July, at the hour of 7:00 p.m. or as soon thereafter as possible, in the City Council Chambers at 663 Main Street in the City of Livingston, the City Council of the City of Livingston (the" City Council") will hold a public hearing as to the proposed assessments of each of the Livingston Benefit Assessment Districts (the "Districts") for fiscal year 2025/2026 where all interested persons will be heard.
WHEREAS, the City Council of the City of Livingston (hereinafter referred to as the "City"), pursuant to the provisions of the Benefit Assessment Act of 1982, Chapter 6.4, Section 54703 et seq of the Government Code of the State of California (hereinafter referred to as the "Act") desires to provide funding to pay the costs and expenses of operating, maintaining, monitoring and servicing public drainage improvements and appurtenant facilities located within the public right of ways, designated easements or specified public areas of the City and benefiting the assessable lands within each respective District for fiscal year 2025/2026, for the purposes provided thereof in the Act; and
WHEREAS, the following Districts subject to the proposed continuation of annual assessments are: Country Glen, Sundance (Country Villas 1, 2, and 3), Country Roads, Kensington Park South (Vineyard Estates), Vinewood Estates, Monte Cristo Estates, Vintage West Areas A & B, Monte Cristo Estates II (Briarwood), Vinewood Estates II (Briarwood), Bridgeport Village, Davante Villas, Country Lane I (Liberty Square), Country Lane II (Kishi), Sundance IV (Country Villas IV), Strawberry Fields, Parkside-Forecast, La Tierra (Rancho Estrada) and Somerset (Sun Valley Estates); and
WHEREAS, the public interest and convenience require for the City to initiate annual proceedings for the levy of assessments within the Districts for fiscal year 2025/2026, for the purposes provided thereof in the Act; and
WHEREAS, the proposed assessment rates for parcels within the original 4 Districts without annual rate increases and the 14 Districts which may be increased annually by the approved CPI rate increase, provide funding for maintenance and operation of the current facilities; and
WHEREAS, in order to maintain the facilities at a standard acceptable to the City the assessments within the Districts will need to be levied for fiscal year 2025/2026; and
WHEREAS, Proposition 218, the Right to Vote On Taxes Act does hereby require that if the assessment rate is to be increased, a balloted assessment protest hearing shall be conducted and heard.
WHEREAS, all District assessments which are subject to annual CPI rate increase increases, such annual rate increases were previously approved through successful balloting of the property owners. As such, these assessment increases require no further balloting as assessment Ballots, protest hearings or related notices as these are not required if assessments are not considered increased.
WHEREAS, an Engineer's Report has been prepared (the "Report")" providing the boundaries which are benefited by the improvements and the amounts to be assessed against each of the parcels within each District. The Report, which references the Districts' boundaries and describes improvements, the method of assessment and descriptions of the parcels to be assessed, is on file in the office of the City Clerk at 1416 "C" Street, Livingston, CA and is open to public inspection. All interested persons are referred to the Report to verify the area of his or her parcel and the amount of the proposed annual assessments upon their properties within the Districts.
The City Council shall hear and consider all comments from the public during the hearing. At the conclusion of the public hearing, the City Council may adopt, revise, change, reduce, or modify any assessment and shall make its determination upon each assessment described in the Report for Fiscal Year 2025/2026.
