NOTICE OF SALE CIVIL ACTION NO. 2024-CP-46-00516 BY VIRTUE of the decree heretofore granted in the case of: Bank of America, N.A. vs. Justin Frank Eastwood; Kimberly Marie Eastwood; Synchrony Bank; Founders Federal Credit Union; Midland Funding LLC, the undersigned Master In Equity for York County, South Carolina, will sell on July 7, 2025 at 11:00 AM, or on another date, thereafter as approved by the Court, at the Moss Justice Center, 1675 York Highway, City of York, State of South Carolina, to the highest bidder:
All that parcel of land in York County, State of South Carolina, as described in Deed Book 4893, Page 34, ID# 5900000060, being known and designated as:
All that certain piece, parcel or lot of land lying, being and situate in the Ebenezer Township, York County, South Carolina, and being designated as Lot 2 Deertrack Subdivision, Section I, recorded in Plat Book 66, Page 213, and being more recently shown on plat of property surveyed for James P. Hill and Tracy L. Hill, drawn by David S. Thomas, SCPLS, dated June 9, 1997 and recorded in the Office of the Clerk of Court for York County in Plat Book 133, Page 733, and being more particularly described according to said plat as follows: Beginning at the joint front corner of Lots 2 and 3, said point being in the center of right of way of Deertrack Drive; thence running with the dividing line of said Lots S.56-30-11 E. 180.95 feet to a point; thence running S. 33-02-06 W. 119.60 feet to a point; thence running N. 56-37-45 W. 181.05 feet to a point in the center of right of way of Deertrack Drive; thence running with said right of way N. 33-05-00 E. 120.00 feet to the point of beginning.
This being the same property conveyed to Justin Frank Eastwood and Kimberly Marie Eastwood by Deed of Secretary of Housing and Urban Development a/k/a United States Department of Housing and Urban Development, an agency of the United States of America, dated December 10, 2002 and recorded December 27, 2002 in Book 4893 at Page 314 in the Office of the Register of Deeds for York County, South Carolina.

TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Master In Equity, at conclusion of the bidding, five percent (5%) of his bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but in the case of non-compliance to be forfeited and first applied to the costs incurred by the Plaintiff related to the sale and the balance then applied to the Plaintiff's debt in a manner suitable to the Plaintiff. Should the last and highest bidder fail to comply with the other terms of the bid within twenty (20) days, then the Master In Equity may re-sell the property on the same terms and conditions on some subsequent Sales Day.
Deficiency judgment being demanded, the bidding will not be closed on the day of sale but will remain open for a period of thirty (30) days as provided by law. Plaintiff is demanding a deficiency. The Plaintiff may waive any of its rights, including its right to a deficiency judgment, prior to sale.
Purchaser to pay for documentary stamps on the Deed. The sale shall be subject to taxes and assessments, existing easements and restrictions, easements and restrictions of record and any other senior encumbrances.
In the event an agent of Plaintiff does not appear at the time of sale, the within property shall be withdrawn from sale and sold at the next available sales date upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or such terms as may be set forth in a supplemental order.
