REQUEST FOR QUALIFICATION AND PROPOSALS FOR: FRESNO SENIOR ACTIVITY CENTER 1. OWNER: City of Fresno 2. PROJECT NAME: Fresno Senior Activity Center 3. PROJECT LOCATION: 4323 North Blackstone Ave., Fresno, CA 93726 4. PROJECT DESCRIPTION: The City of Fresno (Owner) has awarded a Design-Build Contract to ICD-SCA Joint Venture (Design-Builder) for the construction of a new approximately 34,296 square foot senior activity center, pool equipment building, and site development project. On behalf of the Design Builder, S. C. Anderson, Inc., as the construction lead, general contractor, and primary contracting party for all construction-phase work, is soliciting qualifications and proposals for Subcontractors to execute the scope of the work. All construction subcontracts shall be administered, negotiated, and managed exclusively by SCA, subject only to any approvals expressly required under the Joint Venture Agreement. No subcontract shall be binding unless and until executed by SCA and/or the properly licensed Joint Venture entity, as applicable. 5. BID DEADLINE: RFQPs are due on May 5, 2026 by 2:00PM or at any other date or time as set by Addendum. 6. METHOD OF BID RECEIPT: Submit bids via email to estimating@scanderson.com 7. PLANS ARE ON FILE: Plans are available via email at estimating@scanderson.com, the Kern County Builders Exchange, and the Central California Builders Exchange. 8. All responses will be evaluated to determine which qualification/proposal provides the "best value" to the project, utilizing the Proposal Format, as outlined in the Instruction to Bidders. The proposing company with the highest rating will be awarded a contract. Design-Builder has the right to reject any or all bids anticipated by this Request for Qualifications/Proposals. Responding Subcontractors will not be entitled to recover any costs or anticipated profits for preparation of proposals and responses to the Request for Qualification/Proposal. Without limiting the foregoing, SCA reserves the unilateral right (on behalf of the Design-Builder) to: (i) accept or reject any proposal in whole or in part; (ii) waive irregularities; (iii) re-scope, split, or combine bid packages; (iv) negotiate separately with any proposer; and (v) re-bid any portion of the work, all in its sole discretion and without liability to any proposer. Nothing in this RFQP shall be deemed to create any obligation to award a contract to the lowest or highest ranked proposer, and the Design-Builder expressly reserves the right to award contracts in a manner consistent with its construction means, methods, sequencing, and risk allocation determinations. 9. The work hereunder constitutes as "public work" as defined in Chapter 1, Part 7, Division 2 of the California Labor Code, and Contractor shall cause the work to be performed as a "public work" in accordance with such Chapter of the California Labor Code. The Council of the City of Fresno has adopted Resolution No. 82 297 ascertaining the general prevailing rate of per diem wages and per diem wages for holidays and overtime in the Fresno area for each craft, classification, or type of worker needed in the execution of Contracts for the City. Information specific to the Work to be done underthis contract can be obtained by contracting the Contract Compliance Officer at the City of Fresno office of Construction Management (559) 621-5600. Wage determination date established at time of original design-build RFQ date of May 6, 2023. 10.This project is being funded using Community Development Block Grant (CDBP) Program as administered by the U.S. Department of Housing and Urban Development (HUD). This project is subject to the payment of minimum wages mandated by the Davis-Bacon Act of 1931. A copy of the Federal wage rates are enclosed in the contract Agreement between the Owner and Design-Builder. 11.To bid on or perform the work stated in this Notice, proposers must possess a valid and active contractor's license of the trade intended to pursue. No contractor nor subcontractor shall be qualified to bid on, be listed in a bid proposal, subject to the requirements of § 4104 of the Public Contract Code, for a public works project (submitted on or after March 1, 2015) unless currently registered with the Department of Industrial Relations (DIR) and qualified to perform public work pursuant to Labor Code §1725.5. No contractor or subcontractor may be awarded a contract for public work on a public works project (awarded after April 1, 2015) unless registered with the DIR. DIR's web registration portal is: www.dir.ca.gov/Public-Works/Contractors.html. 12. As a part of requirements for qualification, each Subcontractor and its subcontractors, whose scope of work exceeds one-half of 1 percent (0.005%) of the price of the prime contract, must meet the minimum requirements for "skilled labor force availability" pursuant to the California Code, PCC22172(b)(1), meaning that an agreement exists with a registered apprenticeship program, approved by the California Apprenticeship Council, which has graduated apprentices in each of the immediately preceding five years; provided, however, that this graduation requirement shall not apply to programs providing apprenticeship training for any craft that has not been deemed by the Department of Labor and Department of Industrial Relations to be an apprentice-able craft in the five years prior to enactment of the act adding California Code. 13.The successful Proposer will be responsible for all billings, submittals, schedule updates, drawing updates, and required documents, as may be applicable to the project, through our cloud-based project management program, Procore. All subcontractor communications, RFIs, submittals, change requests, schedule coordination, and payment applications shall be submitted to and administered exclusively by SCA. Subcontractors shall not rely on any direction, instruction, or communication from ICD unless expressly authorized in writing by SCA. 14.Contractors and all subcontractors must furnish electronic certified payroll records (eCPR) to the Labor Commissioner [specify weekly, bi-weekly or monthly] in PDF format. Registration at www.dir.ca.gov/Public-Works/Certified-Payroll-Reporting.html is required to use the eCPR system. The following notice is given as required by Labor Code Section 1771.5(b)(1): Contractors and any subcontractors are required to review and comply with the provisions of the California Labor Code, Part 7, Chapter 1, beginning with Section 1720, as more fully discussed in the Contract Documents. These sections contain specific requirements concerning, for example, determination and payment of prevailing wages, retention, inspection, and auditing payroll records, use of apprentices, payment of overtime compensation, securing workers' compensation insurance, and various criminal penalties or fines which may be imposed for violations of the requirements of the chapter. Submission of a bid constitutes contractor's representation that contractor has thoroughly reviewed these requirements. 15.Proposers may be required to furnish a Performance & Payment Bond at the Design-Builder's discretion. Any subcontractor bonding requirements shall be determined solely by SCA and/or its surety. Subcontractors acknowledge that project-level payment and performance bonds will be furnished by SCA and will apply solely to construction services, and not to design services or other matters within ICD's scope of responsibility. 15.The Owner will retain 5% of the amount of any progress payments. 16.The project is subject to Section 3 of the Housing and Urban Development Act of 1968, as amended by the Housing and Community Development Act of 1992. Proposer to adhere to all participation and reporting requirements. Refer to the Agreement between the Owner and Design-Builder for more information. 17.The project is subject to Build American Buy America (BABA) requirements limited to only iron and steel.
