RESOLUTION OF INTENT TO LEVY AN ADDITIONAL TAX PURSUANT TO SECTION 3-14.3 OF THE ILLINOIS PUBLIC COMMUNITY COLLEGE ACT WHEREAS, Section3-14.3 of the Illinois Public Community College Act authorizes the board of a community college district to levy an additional tax upon the taxable property of the district in any year in which the Illinois Community College Board issues a certificate of eligibility to do so; and WHEREAS, Section 3-14.3 states that the additional tax may be used to increase the total taxing authority of the district to the most recently reported statewide average actual levy rate in cents per $100 of equalized assessed value for educational and operations and maintenance purposes as certified by the Illinois Community College Board; and WHEREAS, the Board of Trustees of Community College District No. 522, Counties of St. Clair, Madison, Monroe, Randolph, Washington, Bond, Perry and Montgomery, State of Illinois, has received from the Illinois Community College Board a certificate of eligibility to levy an additional tax pursuant to Section 3-14.3; and WHEREAS, said certificate of eligibility states that the Board is eligible to levy at a combined educational and operations and maintenance purposes rate up to and including 27.47 cents per $100 of assessed valuation in accordance with the provisions of Section 3-14.3; and WHEREAS, a true copy of said certificate of eligibility is attached to this Resolution and incorporated herein by reference; and WHEREAS, said certificate of eligibility further states that the Board has met all of the eligibility requirements set forth in Section 3-14.3; and WHEREAS, Section 3-14.3 requires the Board to publish this Resolution after its passage in order to give district voters an opportunity to request a referendum on the additional tax levy proposed herein; and WHEREAS, it is in the best interest of Southwestern Illinois College and the district for the Board to state its intent to levy an additional tax under Section 3-14.3. NOW THEREFORE, BE IT RESOLVED by the Board of Trustees of Illinois Community College District No.522 as follows: Section 1: The Board has received a certificate of eligibility from the Illinois Community College Board authorizing the Board to levy an additional tax pursuant to Section 3-14.3 of the Illinois Public Community College Act. Section 2: Southwestern Illinois College has met all of the eligibility requirements of Section 3-14.3. Section 3: The Board herewith states its intent to levy an additional tax pursuant to Section 3-14.3 under the terms set forth in the certificate of eligibility. Section 4: The Chairman of the Board and the Secretary are authorized to publish the notice to district voters as required by Section 3-14.3. Section 5: A certified copy of the Resolution, accompanied by the certificate of eligibility, shall be filed in the office of the County Clerks of St. Clair, Madison, Monroe, Randolph, Washington, Bond, Perry, and Montgomery. Section 6: This Resolution shall be in full force and effect upon its passage.
