NOTICE OF PUBLIC HEARING REGARDING THE PROPOSED ANNEXATION OF TERRITORY TO MODESTO SYLVAN SCHOOLS INFRASTRUCTURE FINANCING AGENCY COMMUNITY FACILITIES DISTRICT NO. 2022-1 (CROSSROAD WEST) Notice is hereby given that the governing body (the "Agency Board") of the Modesto Sylvan Schools Infrastructure Financing Agency (the "Agency") will conduct a Public Hearing on June 24, 2026, at 5:30 p.m. ("Public Hearing"), or as soon thereafter as the matter may be heard, in the Sylvan Union School District Boardroom, located at 605 Sylvan Avenue, Modesto, California 95350, to consider the proposed annexation of certain property (the "Property") to the above-named community facilities district (the "District"). The District was established pursuant to the Mello-Roos Community Facilities Act of 1982, as amended, commencing at Section 53311 of the California Government Code (the "Act"). The location of the Property is more specifically described in the map attached as Exhibit A to the Resolution of the Agency declaring its intention to annex the Property to the District, adopted on May 13, 2026 (the "Resolution"), by the Agency Board. A copy of the Resolution and the associated staff report are on file and available for public inspection in the office of the Secretary of the Agency (the "Agency Secretary") at Sylvan Union School District, 605 Sylvan Avenue, Modesto, California 95350. Upon the annexation of the Property to the District, the Property will be subject to the special tax (the "Special Tax") levied pursuant to the rate and method of apportionment (the "Rate and Method") set forth in Exhibit B of the Resolution. At the Public Hearing, the testimony of all interested persons or taxpayers for or against the annexation of the Property and the levy of Special Tax within the Property will be heard. Section 53339.6 of the Act provides that, if 50 percent or more of the registered voters (or six registered voters, whichever is more), residing within the existing boundaries of the District, or if 50 percent or more of the registered voters (or six registered voters, whichever is more), residing within the Property proposed to be annexed, or if the owners of one-half or more of the area of land within the existing boundaries of the District and not exempt from the Special Tax, or if the owners of one-half or more of the area of land in the Property proposed to be annexed and not exempt from the Special Tax, file written protests against the proposed annexation of the Property to the District, and protests are not withdrawn so as to reduce the protests to less than a majority, no further proceedings to annex the Property shall be undertaken for a period of one year from the date of decision of the Agency Board on the issues discussed at the Public Hearing. If the Agency Board determines to continue with the annexation proceedings after the Public Hearing, a special election will be held within the District to authorize the levy of the Special Tax within the Property, in accordance with the procedures contained in Section 53326 of the Act. If held, the proposed voting procedure at the election will be a landowner vote with each landowner who is the owner of record of land within the territory of the Property at the close of the Public Hearing, or the authorized representative thereof, having one vote for each acre or portion thereof owned within the territory of the Property. Under the Act, the Agency Board may conclude the Public Hearing on June 24, 2026, or may continue the Public Hearing to a later date. Interested persons are invited to attend this meeting and be heard regarding this matter. An individual who challenges any decision regarding the proposed actions in court may be limited to raising only those issues such individual or someone else raised at the meeting described in this notice or in written correspondence delivered to the Agency Board at, or prior to, the meeting. Due to the time constraints and the number of persons wishing to give oral testimony, time restrictions may be placed on oral testimony at the meeting regarding the proposal. Any interested person may wish to make comments in writing to assure that the relevant views are expressed adequately. Written comments may be submitted to the Agency Board prior to the time set for the meeting, to the attention of Lizett Aguilar, Agency Secretary at Sylvan Union School District Boardroom, located at 605 Sylvan Avenue, Modesto, California 95350.
