NOTICE OF SALE
BY VIRTUE of a decree heretofore granted in the case of: Locust Point Seniors Housing Debt Fund II, L.P. v. Pines-Bluffton LLC, et. Al., Civil Action Number 2025-CP-07-00418, James J. Wegmann, Master in Equity for Beaufort County, has ordered that following property, which is the subject of the above action, be sold on December 1, 2025, at 11:00 a.m. at the Beaufort County Courthouse, Room 212, to the highest bidder:
All that certain piece, parcel or tract of land situate, lying and being in Beaufort County, South Carolina, measuring and containing 10.16 acres, more or less, as shown on that survey entitled "An ALTA/ACSM survey of Southern Assisted Living" dated February 12, 1999, by Connor and Associates, Inc. and also being all of Parcel A as shown on that plat recorded in Plat Book 51, Page 141 in the Office of the Register of Deeds for Beaufort County, South Carolina.
Said parcel is more fully described as follows:
Beginning at an iron pin located on the southern right-of-way of U.S. Highway 278, and the western right-of-way of Simmonsville Road, being the point of commencement, thence running along a curve to the left having a radius of 3,655.72', a chord bearing of N 46° 51' 33" W, 322.86', along the southern right-of-way of US. Highway 278, to a concrete monument, thence N 49° 23' 24" W, 212.61' to an iron pin, being the Point of Beginning, thence turning and running the following courses: S 43° 53' 52" W, 843.98' to a concrete monument; N 46° 06' 08" W, 531 .13' to a concrete monument; N 43° 53' 52" E, 818.42' to a concrete monument; S 49° 24' 28" E, 417.28' to a concrete monument; S 46° 28' 20" E, 99.88' to a concrete monument; S 49° 25' 06" E, 14.69' to a concrete monument, Being the Point of Beginning.
Together with the Borrower's rights in and to any water and sewer capacity allocated on the records of Beaufort-Jasper Water and Sewer Authority to the above-described property, including the right of Borrower to any reductions in the wastewater and water capacity fees to which Borrower is entitled, without any warranty or representation regarding same being made by Borrower.
LESS AND EXCEPT: All that certain piece, parcel or tract of land, together with any improvements located thereon, situate, lying and being on the southwestern side of Fording Island Road (US 278), in the County of Beaufort, in the State of South Carolina, being shown and designated as PARCEL B, containing 7.082 ACRES, more or less, on a Survey for Wind River Companies by Site Design, Inc., dated April 21, 2021, and recorded September 11, 2024, in the Office of the Register of Deeds for Beaufort County, SC, in Book 164 at Page 113; and having the boundaries and measurements as shown on said plat with reference being craved thereto as often as is necessary for a more complete and accurate legal description.
This being a portion of the property conveyed to Pines-Bluffton LLC by deed of SC Senior 1, LLC, recorded in the Office of the Register of Deeds for Beaufort County on September 6, 2023 in Book 4272 at Page 2541.

TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Master in Equity at conclusion of the bidding, five percent (5%) of his bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff's debt in the case of non-compliance. Should the last and highest bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Master in Equity may resell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder). Personal Deficiency being demanded, the bidding will remain open for 30 days, but compliance with the bid may be made immediately. Purchaser to pay for documentary stamps on Deed. The successful bidder will be required to pay interest on the amount of the bid from the date of sale to date of compliance with the bid at the rate of 12.0% per annum. Plaintiff may waive any of its rights, including its rights to a deficiency judgment, prior to sale.
