SUBSTITUTE TRUSTEE'S NOTICE OF FORECLOSURE SALE WHEREAS on June 6, 2006, CYNTHIA S. JOACHIM, A SINGLE PERSON, executed a Deed of Trust to Andrew Valentine, ESQ., as Trustee, and Mortgage Electronic Registration Systems, Inc., solely as nominee for AMERICAN BROKERS CONDUIT, as Beneficiary, which Deed of Trust is on file and of record in the office of the Chancery Clerk of Harrison County Second Judicial District), Mississippi, as Instrument Number 2006-4367-T-J2; and WHEREAS, Mortgage Electronic Registration Systems, Inc., solely as nominee for AMERICAN BROKERS CONDUIT assigned said Deed of Trust to Ocwen Loan Servicing LLC via an instrument filed June 24, 2014 and recorded as Instrument Number 2014-1729T-J2 in the office of the Chancery Clerk of Harrison County (Second Judicial District), Mississippi; and WHEREAS, Ocwen Loan Servicing LLC assigned said Deed of Trust to Nationstar Mortgage LLC via an instrument filed April 20, 2016 and recorded as Instrument Number 2016-1081-T-J2 in the office of the Chancery Clerk of Harrison County (Second Judicial District), Mississippi; and WHEREAS, Nationstar Mortgage LLC assigned said Deed of Trust to MTGLQ Investors LP via an instrument filed October 9, 2019 and recorded as Instrument Number 2019-3077-T-J2 in the office of the Chancery Clerk of Harrison County (Second Judicial District), Mississippi; and WHEREAS, MTGLQ Investors LP assigned said Deed of Trust to Ajax Mortgage Loan Trust 2020-A, Mortgage Backed Securities, Series 2020-A by U.S. Bank National Association, as Indenture Trustee via an instrument filed October 5, 2020 and recorded as Instrument Number 2020-2683-T-J2 in the office of the Chancery Clerk of Harrison County (Second Judicial District), Mississippi; and WHEREAS, Ajax Mortgage Loan Trust 2023-C by U.S. Bank National Association, as Indenture Trustee appointed Wilson & Associates PLLC in place of the afore-mentioned original Trustee via an instrument dated April 13 2022 and recorded as Instrument No. 2022-0002916-T-J2 in the office of the Chancery Clerk of Harrison County (Second Judicial District), Mississippi; and WHEREAS, Ajax Mortgage Loan Trust 2020-A, Mortgage Backed Securities, Series 2020-A by U.S. Bank National Association, as Indenture Trustee assigned said Deed of Trust to Ajax Mortgage Loan Trust 2023-C by U.S. Bank National Association, as Indenture Trustee via an instrument filed September 15, 2023 and recorded as Instrument Number 2023-0005489-T-J2 in the office of the Chancery Clerk of Harrison County (Second Judicial District), Mississippi; and WHEREAS, U.S. Bank Trust Company, National Association, as Indenture Trustee on behalf of and with respect to Ajax Mortgage Loan Trust 2023-C, Mortgage Backed Securities, Series 2023-C appointed Padgett Law Group as Substitute in place of the afore-mentioned original Trustee and substituted Trustee via an instrument filed September 22, 2025 and recorded as Instrument Number 2025-0006703-D-J2 in the office of the Chancery Clerk of Harrison County (Second Judicial District), Mississippi; and WHEREAS, default has occurred in the payment of the indebtedness secured by said deed(s) of trust, and U.S. Bank Trust Company, National Association, as Indenture Trustee on behalf of and with respect to Ajax Mortgage Loan Trust 2023-C, Mortgage Backed Securities, Series 2023-C, as beneficiary, has authorized and instructed Padgett Law Group as substitute trustee to foreclose said deed(s) of trust by advertisement and sale at public auction in accordance with the statutes made and provided therefor. THEREFORE, notice is hereby given that pursuant to the power of sale contained in said deed(s) of trust and in accordance with the statutes made and provided therefor, the said deed(s) of trust will be foreclosed and the property covered thereby and hereinafter described will be sold at public auction to the highest bidder for cash at the South front door of the Harrison County Courthouse (Second Judicial District), 730 Dr. Martin Luther King Jr. Boulevard, Biloxi, Mississippi 39530 and will sell within legal hours (being between the hours of 11:00 AM and 4:00 PM) on October 30, 2025, to satisfy the indebtedness now due under and secured by said deed(s) of trust. Padgett Law Group will convey only such title as vested in it as Substituted Trustee. The premises to be sold are described as: Lot Twenty-seven (27), POPPS FERRY PLACE, PHASE THREE (3), a subdivision according to the official map or plat thereof; on file and of record in the office of the Chancery Clerk of the Second Judicial District of Harrison County, Mississippi in Plat Book 13 at Page 23 thereof; reference to which is hereby made in aid of and as a part of this description. The successful bidder must tender full funds at the conclusion of the sale in the form of a certified check made payable or endorsed to Padgett Law Group. No personal checks will be accepted. To this end you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded. Padgett Law Group reserves the right to award the bid to the next highest bidders should the highest bidder fail to timely tender the total amount due.
